Definitions

What is a tipping competition?
If entry is free, it is treated as a trade promotion lottery which is conducted to promote the sale of goods or the use of services, in which every participant in the lottery takes part:

  • without cost
  • by reason of the goods or use of services, the cost of which is no greater than the cost would be without the opportunity to participate in the lottery.

If an entry charge is payable, then the competition is treated as a "progressive draw lottery".

Permit details

Do I need a Licence or Permit to Conduct a Tipping Competition?
For the purposes of a trade promotion, then a permit is not required. However, a permit can be applied for and is your approval to conduct the competition.
For the purposes of a progressive draw lottery, then a permit is not required if the competition satisfies the following criteria:

  • the weekly prize does not exceed approximately $200
  • the aggregate prize value for the football season does not exceed $10,000.

An application must be lodged at least 14 days before the commencement and the permit holder must be 18 years or over.

Licence period

For a trade promotion lottery, a permit will be issued for the period requested in the application up to a maximum of 12 months.
For a progressive draw lottery, it is 7 days or 3 months. Therefore tipping competition holders may need to re-apply

Fee
For a trade promotion lottery, none.
For a progressive draw lottery, the cost of a 3 month permit depends on the prizes offered:

$0 - $5,000 $35
$5,001 - $50,000 $85
$50,001 - $100,000 $165
$100,001 - $200,000 $340
over $200,000 $565

Additionally, where the total prize value is $10,000 or over, your organisation must satisfy the Operations Division that it is capable of financing the lottery. You can:

  • provide a bank guarantee for the total prize value;
  • lodge a security deposit for the total prize value with the Operations Division.

 

Competition details

Is there a maximum amount payable by participants?
If a participant in a tipping competition is required to call a 1900-telephone number in order to enter, the cost for calling that number must not exceed 50 cents + GST.

Distribution of proceeds
For a progressive draw lottery the use of funds must be stated in the application form.

Advertising Results
Results must appear in a nominated newspaper, on a nominated date.

Information needed

What must the rules of the competition provide?
Each trade promotion lottery ticket must have the following information:

  • the value and/or description of the prize must be printed on the entry coupon.
  • conditions of the entry must be printed in the entry coupon.
  • the method for determining the winner shall be clearly stated or otherwise made clear.

Each progressive lottery ticket must have the following information:

  • permit number
  • price of ticket
  • description and value of prizes
  • ticket number name and address of permit holder
  • name of organisation
  • closing date of ticket sales, and drawing date
  • name/date of newspaper in which results will appear

Records to be kept
Records relating to the lottery shall be maintained for a period of 12 months.

Are records subject to inspection?
Yes, records must be made available to an authorised officer of the Gaming Commission upon request.

Guarantees
For a progressive draw lottery, where the total prize value is greater than $10,000, the organiser must satisfy the Operations Division that it is capable of financing the lottery.
